Terms and Conditions
The terms you agree to when you take part in any Play Pickle program, service or event.
Play Pickle Terms and Conditions
1. Acceptance of Terms
By participating in any pickleball program, service or event offered by Play Pickle, whether as a participant, player, spectator, coach, or in any other capacity, you are accepting and agreeing to the terms and conditions of play. You acknowledge that you have had sufficient opportunity to read and understand these terms and conditions before choosing to participate.
Age Requirement: All Play Pickle programs (except dedicated children's programs) require participants to be 18 years or older. Participants under the age of 18 must be accompanied by a parent or guardian.
2. Acknowledgement of Risk
Pickleball, like all sports, carries inherent risks that cannot be eliminated regardless of the care taken to prevent or minimise harm. These risks range from minor injuries such as bruises, strains, and sprains to major injuries such as broken bones, torn ligaments, concussions, and other medical conditions, up to and including death. By choosing to participate, you recognise and understand these risks.
3. Assumption of Risk
By participating in Play Pickle's pickleball programs, you knowingly and freely assume all such risks, both known and unknown, relating to your participation, and you accept personal responsibility for any damages resulting from such risks.
4. Personal Injury Insurance
Play Pickle does not offer personal injury insurance for participants. All participants are strongly encouraged to have their own personal injury and health insurance coverage. It is the sole responsibility of each participant to secure adequate insurance to cover any injuries or damages they might sustain while participating in Play Pickle activities.
5. Health Declaration
You confirm that you are physically fit and have no medical condition that would prevent your full participation in pickleball activities. If you have any concerns, speak to your registered medical professional.
6. Release of Liability
You hereby discharge and hold harmless Play Pickle, its agents, representatives, employees, and any other individuals or entities acting on its behalf, from any and all claims, actions, liabilities, damages, losses, costs, or expenses, whether known or unknown, arising from or related to your participation in any Play Pickle pickleball program.
7. Medical Treatment
In the event of an injury or medical emergency while participating, you grant Play Pickle permission to seek emergency medical treatment on your behalf. You agree to be solely responsible for any associated medical or related bills that may arise.
8. Photography and Media Release
By participating in any Play Pickle program, service or event, you agree that you may be photographed, filmed or recorded, and you consent to Play Pickle taking photographs and video footage of you.
You grant Play Pickle the right to use these photographs and recordings for any lawful purpose, including promotional and marketing materials, across any media, without compensation to you. If you would prefer not to be photographed or filmed, please let a Play Pickle host or coach know.
9. Programs and Activity Supervision
Some activities run by Play Pickle are self-organised and may not have a designated facilitator or supervisor present.
Certain programs may take place without a first-aid kit or a designated first-aid officer on-site.
Participants are responsible for their own safety and are advised to have their own first-aid provisions and contact emergency services (000) in the event of an incident or injury.
10. Continuation and Acknowledgement of Agreement
Your participation in any Play Pickle pickleball program or event signifies your understanding and agreement to the terms of this Participation Agreement. By choosing to participate, you forgo any rights to bring legal action against Play Pickle for any reason covered by this agreement.
This agreement applies to all current and future participation in any pickleball program or event offered by Play Pickle.
11. Email Marketing and Communications
By signing up to the Play Pickle app, you agree to receive email marketing and promotional communications from Play Pickle.
You can opt out at any time by using the unsubscribe link in any marketing email, or by contacting us at hello@playpickle.com.au. We will still send you essential communications relating to your bookings and account.
12. Bookings, Cancellations and Virtual Credits
Play Pickle uses Virtual Credits for eligible cancellations. All bookings are charged at the time of booking.
If you cancel within the free cancellation window, the full booking value is returned to your Play Pickle account as Virtual Credit. The free cancellation windows are: (a) Social Play and general programs — more than 24 hours before the session; and (b) clinics and coaching programs — more than 7 days before the program or session.
Cancellations made after the applicable free cancellation window has closed are not eligible for Virtual Credit or a refund.
If Play Pickle cancels a session — for example due to wet weather, insufficient participant numbers, venue issues or other operational reasons — the full booking value is automatically returned to your account as Virtual Credit.
Virtual Credits may be applied at checkout towards eligible future Play Pickle bookings. To view your balance, open the Play Pickle app or website, select More (•••), and your Virtual Credit balance appears at the top of the page, directly beneath your name.
Play Pickle does not provide cash refunds or reversals to the original payment method for cancelled bookings.
